• You must be at least 13 to use the Service. If you are under 18, please ensure you have permission from a parent or guardian before making any donations.
• You can only sign in via supported third-party providers (e.g., Google, Twitch, Discord). Email/password accounts are not offered.
• You are responsible for your sign-in credentials with those providers and for all activity that occurs under your account when connected to the Service.
• Do not create multiple accounts to gain an advantage. We may limit or close duplicate accounts.
• You may request account deletion via in-product controls (where available) or by emailing privacy@ball-iq.com. Some data may be retained where we have legal obligations or legitimate interests (e.g., security logs).

2.1 Overview

Ball IQ is a football-themed quiz game with solo and head-to-head modes. There are no public leaderboards or chat/community features at this time.

2.2 Fair Play

• No bots, scripts, or automation to submit answers or interact with the Service.
• Do not exploit bugs, vulnerabilities, or unintended mechanics.
• Do not reverse engineer, decompile, or attempt to extract source code except to the extent permitted by law.
• Do not bypass rate limits, access controls, or other technical restrictions.
• Do not share live answers or collude in head-to-head modes.

2.3 Acceptable Use

You must not use the Service for illegal content or activities, IP infringement, harassment or hate speech, doxxing, sexually explicit or excessively violent content, or to share others’ personal data without permission. Political opinions are permitted provided they comply with these rules and do not incite violence.

2.4 Security Testing

Do not perform penetration tests or security research without prior written permission (see Section 13). Unauthorized testing may result in suspension and legal action.

2.5 Game Integrity

We may review, audit, or correct game results for fairness, suspected cheating, or technical errors.

UGC includes anything you submit or display on the Service (e.g., usernames, avatar images, profile info, feedback, bug reports, and other submissions). There is currently no chat functionality.

• You retain ownership of your UGC. You grant Ball IQ a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, publish, publicly display, and distribute your UGC only to operate, improve, promote, and provide the Service (including backups and moderation).
• You represent that you have all rights needed for your UGC and that it complies with these Terms and applicable law.
• We may remove or restrict UGC at our discretion (e.g., for policy violations or legal risk). You can appeal by emailing appeals@ball-iq.com.

• Donations are processed by Ko-fi (or other approved processors we may add or change). You may need to agree to their terms and complete Strong Customer Authentication (SCA) where applicable.
• Donations are voluntary and, unless required by law, non-refundable. If you believe a charge is unauthorized, contact us and your payment provider promptly.
• Displayed amounts may include or exclude taxes as indicated. You are responsible for any taxes, fees, or data charges that apply.
• Gameplay is for fun and ranking within a match only. We do not award prizes unless explicitly stated in official rules for a specific promotion.

• The Service (including software, questions, graphics, and trademarks) is owned by or licensed to Ball IQ and protected by law.
• Except as permitted by law, you may not copy, modify, distribute, or create derivative works without our permission.
• Open-source components, if any, are governed by their respective licenses.

• When you connect a third-party account (e.g., Google, Twitch, Discord), you authorize us to receive information those providers share per their terms and your settings. We are not responsible for third-party services.
• We rely on reputable vendors (e.g., Fly.io for hosting, Cloudflare for security/CDN, Ko-fi for donations). Service availability may be affected by those providers.

Your use of the Service is also governed by our Privacy Policy and Cookie Policy, which explain what personal data we collect, why, and how you can exercise your rights. Those policies are incorporated by reference into these Terms.

• No SLA is provided. We may add, remove, or modify features (including beta features), or suspend/stop the Service.
• We may apply technical limits (e.g., rate-limiting) and perform maintenance. We are not responsible for your network, device, or data charges.

To report alleged infringement or unlawful content, email ip@ball-iq.com with: (a) your contact details; (b) a description/URL of the content; (c) the basis of your claim; and (d) any supporting documents. We may request more information. We may terminate accounts of repeat infringers.

• The Service is provided “as is” and “as available” without warranties of any kind (express or implied), including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
• You are responsible for your devices, internet connection, and compliance with these Terms.

• Nothing in these Terms limits your non-excludable statutory rights, or our liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be excluded under applicable law.
• To the extent permitted by law, we will not be liable for (a) loss of profits, revenue, or data; (b) indirect or consequential losses; or (c) damages exceeding the greater of £50 or the amounts you paid to us (if any) in the 12 months before the claim arose.

• We may suspend or terminate your access for breach of these Terms, for legal or security reasons, or where reasonably necessary to protect the Service or users.
• Upon termination, licenses granted to you end; provisions that by their nature should survive (e.g., Sections 3, 5, 9–15) will continue to apply.

• Do not probe, scan, or test the vulnerability of the Service without written authorization.
• Report suspected security issues to security@ball-iq.com with details. Acting in good faith (testing only your own account, avoiding privacy violations, following our instructions), we will not pursue legal action for your responsible disclosure.

If changes are material, we will provide reasonable notice (e.g., in-product message or email) before they take effect. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and, where applicable, delete your account.

• Governing law and venue: England and Wales. Courts of England and Wales have exclusive jurisdiction, except that consumers living in Scotland or Northern Ireland may bring claims in their local courts. If you live outside the UK, any mandatory consumer protection rights of your country of residence still apply and are not limited by these Terms.
• Severability: If any provision is invalid or unenforceable, the remaining provisions remain in effect.
• Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms as part of a reorganization or transfer of the Service.
• No waiver: Failure to enforce a provision is not a waiver.
• Entire agreement: These Terms, together with policies referenced here, form the entire agreement between you and us regarding the Service.
